RULES AND REGULATIONS

ELIGIBILITY
Donating purchaser, and anyone to whom an entry purchaser legally transfers an entry, must be an individual 18 years or older at the time of entry purchase. Individuals are encouraged to purchase as many tickets/donations as they like. Individuals purchasing/donating the ticket(s) will have their name listed on the ticket(s). Purchaser name should be same as receipt ticket name. All federal, state and local laws and regulation apply. Entries are purchased via the internet only. The Operation 12th Man Fundraiser is conducted in English. Ticket confirmation numbers are the order confirmation numbers from the generated receipt. THIS IS YOUR TICKET. DO NOT LOSE THIS. It is the purchaser’s responsibility to provide a valid mailing address and/or email address to Operation 12th Man. Our agents, board, vendors, volunteers, and members assume no liability for lost, late, misdirected, mutilated, incomplete, illegible, undelivered entries/donations or entries/donations without proper payment received, which entries shall be deemed invalid and shall be immediately disqualified. By entering the Fundraiser, the entry purchaser acknowledges that he or she is aware of, and agrees to abide by, the Official Fundraiser rules and regulations.

PRIZES
Two hundred (200) gifts will be presented in the Operation 12th Man Fall 2009 Fundraiser. The chance of a single ticket holder receving a gift is approximately is 1 in 100!. The approximate value of all combined gifts is $300,000 MSRP and is based on estimated MSRP pricing at the time of gift selection. No gift is valued at less than $100.00 MSRP. All automobiles, trucks, and vehicles come base model factory equipped and recevier(s) are also solely responsible for any and all state and local license, title, registration, taxes, or fees associated with the vehicle, as well as insurance (proof of which must be shown prior to possession) and pickup or delivery costs at the dealership as well as any non-standard options chosen by the recepient(s) and negotiated with the dealership. All vehicles are subject to availability at the automobile dealership and chosen by Operation 12th Man and may be substituted with a comparable vehicle by Operation 12th Man.

The Grand Prize Winner may select one of the cash alternatives by providing Operation 12th Man, LLC with written notification of cash alternative selected which is either:

1) One lump sum payment of $150,000.
2) The payment of the $150,000 cash prize via an annuity that will pay five (5) equal, annual payments of $30,000.

The first payment will be made within 45 days after winner has been notified.

Operation 12th Man will require written notification of acceptance of this option within 30 days. The Grand Prize Winner must comply with all terms stated in the official fundraiser rules. If these conditions are not met, then Grand Prize winner shall automatically receive the one-time lump sum cash payment stated. Herein full satisfaction of the Grand Prize. If fewer than 17,500 total tickets are sold by 11:59pm (EST) on December 30th 2009, then the fundraiser will run for another 45 days.

All 20,000 tickets must be sold by the end of the fundraiser in order for the home to be awarded.

All Donations made to this fundraiser are non-refundable.

NOTIFICATION OF GIFT WINNERS
All gift winners will be notified in writing via e-mail or by phone of the prize won and any requisite procedure to claim the gift. All giftss, excluding vehicles, will be sent to the winners’ home addresses only. Winners of all gifts shall have 21 days from notification of winning, to inform Operation 12th Man of their choice to take the prize, accept the cash alternative or select any other offered alternatives. If a selected recepient is unable to be contacted after a period of one (1) month, from the draw date of the Fundraiser drawing, the gift or its cash equivalent will be deemed to have been donated to Operation 12th Man for use in the next fundraiser. All gift winners, by entering, authorize Operation 12th Man to publish their name and likeness on the website and for it to be used in other promotional materials by Operation 12th Man.

TAXES AND IRS RULES
All gift winners shall be responsible for any and all federal, state, and local income or excise taxes, fees, assessments, and like charges associated with the gifts. All cash gifts will be paid net of applicable income tax withholding.

WAIVER/LIMITATIONS OF LIABILITY
Entry purchasers/donators, by participating release Operation 12th Man, LLC and its respective board, committee members, volunteers, partners, representatives, sponsors, service agencies and independent contractors, officers, employees including advertising, public relations, and promotion agencies, from any and all liability with respect to participation in the promotion and possession or use of the gift(s) awarded and also acknowledgement that they did not receive any representations, warranty or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness. Any liability of Operation 12th Man shall be limited to ticket price paid, and in the case of any dispute, Operation 12th Man’s decision shall be final. Operation 12th Man reserves the right to modify or amend the Official Fundraiser Rules without notice at any time.
